Deck error - Illegal Deck - Argument for downgrade?

During the Realm champs this weekend, during round 3 or 4, the judges were forced to give out 2 game loss penalties for cards that had been dropped/misplaced. In both cases, the card was one that already put the player at a disadvantage, then they get a game loss on top of that. It just seemed a little harsh to issue a game loss of a first time infraction that was to the detriment of the player already.
I also understand that by the letter of the law, this was the correct call to make, and the guidelines state that it is assumed the infractions are unintentional. I think Simon did the right thing, and did a great job judging all day for the record, my point is it seems like the rule may be a little harsh. Thoughts?
