The Ilegal Deck and Failure to De-Side Deck experiement

We tried something new at WoW nationals and I would like to get every ones feedback. Also I want everyone to understand what I am about to present is a deviation from from PG. After a discussion with the Head Judge (Paul Ross), he decided to implement this change for this tournament. Unless Alex, or some other official source says otherwise, you should continue to follow the PG as written.
By default, if you assign the Illegal Decklist or Failure to De-Side Deck infractions to a player, you give them the game loss penalty. We decided to establish some guidelines in which the floor judge would have the authority to down grade to a warning. Those guidelines are as follows.
1. The player discovered the error himself and immediately called over a judge.
2. The player did not or could not have received any potential benefit.
3. The error was caught at the beginning of the game.
4. The player had not previously received a downgraded Illegal Deck or Failure to De-Side Deck infraction.
Let me give you some examples.
Example 1:
The player shuffles his deck and presents it to his opponent. While he is shuffle his opponents deck, he notices one of his cards on the table. If he immediately calls over a judge and this is the first time this has happened to him this tournament, the judge would downgrade his penalty to a warning. He would then have the player shuffle the card back into his deck and represent his deck to his opponent.
Example 2:
A player draws his opening hand and sees one of his side deck cards. If he immediately calls over a judge and this is the first time this has happened this tournament, the judge would downgrade his penalty to a warning. He would then have the player fix his deck, shuffle and then represent his deck to his opponent.
