I remember there was a ruling saying that with major riot you can not set level 5 or higher monster, but I can not find that ruling anywhere...has the ruling changed?
Read the text of Major Riot. It doesn't say anything about being restricted towards monster levels. It just wants the same number of monsters to be re-summoned onto the field. As long as the monsters being summoned can be summoned in that fashion. Such as Tsukuyomi couldn't be summoned where as Dekoichi the Battlechanted Locomotive could.
Rule 2 says that you can't set a Swift Gaia the Fierce Knight, even if it's the only monster in your hand. I would lean towards the idea that you cannot special summon a monster 5 star and above with Major Riot.
If this is the only card in your hand, you can Summon this card in face-up Attack Position without Tributing monsters. This is treated as a Normal Summon.
